What the process usually involves, how custody decisions are actually made, and why the cheapest route is agreement wherever you can reach it.
Family cases are unusual in that the legal process and the emotional one run at completely different speeds, and the legal one is slower.
The rough shape of it
Most divorces resolve by agreement rather than by a judge deciding. The work is dividing property and debt, arranging support, and where there are children, settling where they live and how decisions get made. How much of that is negotiated versus litigated is the single biggest driver of both the cost and how long it takes.
How custody is actually decided
Courts apply a best interests standard. In practice that means stability and routine, how involved each parent has genuinely been, each parent's capacity to meet the child's needs, the child's own relationships and schooling, and depending on age sometimes the child's wishes. The precise factors are set by each state.
Two things people misunderstand. Legal custody, meaning who decides on school and medical care, is separate from physical custody, meaning where the child sleeps. And custody arrangements can usually be revisited if circumstances change materially, so the first order is rarely the last word.
What to gather early
Financial disclosure is required and it is where the time goes. Pay records, tax returns, account statements, mortgage and loan documents, retirement accounts, anything owned before the marriage and anything inherited. Getting this in order early is the cheapest thing you can do, because your lawyer assembling it at an hourly rate is the expensive alternative.
Cost, and how to keep it down
Family work is normally hourly, so the bill tracks conflict. Mediation and collaborative approaches cost substantially less than a contested case, and every issue you can settle directly is one nobody bills to argue. That is not an argument for conceding things that matter. It is an argument for being clear about which ones actually do.
If there is any safety concern
If you or your children are at risk, that changes the order of everything and there are protective steps available quickly. Say so at the first opportunity rather than waiting for it to come up.
